CUP becomes effective for new Dunkin’ Donuts

The County Council last week accepted a report from the county Planning Commission approving a request for a conditional-use permit, or CUP, for a Dunkin’ Donuts restaurant off Telegraph Road.

The permit became effective June 29 — 15 days from the June 14 council meeting, when the commission’s report was ordered received and filed with the county by 6th District Chairman Steve Stenger, D-south county. The commission voted 6-0 on May 9 to approve the CUP request.

Plans call for the demolition of the existing Jazzercise studio at 4220 Telegraph Road in the Telegraph South Center to make way for the roughly 2,000-square-foot stand-alone restaurant, which will include a drive-through. The sit-down restaurant will be open daily from 6 a.m. until 10 p.m., and the drive-through window will be open 24 hours, according to the commission’s report to the council.

During a public hearing on the proposal in April, residents of the neighboring Birchwood Estates subdivision told the commission they were concerned about the additional traffic and noise the business may generate.

However, the commission stated in its report that the restaurant and drive-through are “reasonable and appropriate” for the location.

Noting the Telegraph South Center was built in 1967 an “has several vacant storefronts,” the commission stated, “The new restaurant will be an upgrade for the center and will not detrimentally impact the adjoining land uses. The adjoining single-family residences that are located to the north of the subject site sit much higher than the proposed restaurant. The proposed (drive-through) would circulate counter-clockwise around the Dunkin’ Donuts building and the pickup window would be located on the west side of the building.

“Therefore, the department believes that the lighting and potential noise associated with the restaurant will not adversely impact these properties.”
