St. Charles company drops federal lawsuit over Crestwood’s denial of cell phone tower

A wireless development company that was denied permission to construct a cell phone tower in Crestwood has dropped its federal lawsuit against the city.

St. Charles Tower Inc. on Nov. 23 filed a notice of voluntary dismissal in U.S. District Court.

The company originally filed suit in August.

It contended Crestwood officials and the city’s Board of Zoning Adjustment lacked sufficient evidence and violated laws governing religious exercise when they rejected its application for an administrative permit to build a 110-foot cell phone tower at the Episcopal Church of the Advent, 9973 Garber Road.

The site is in Ward 3 and is zoned residential.

City Attorney Rob Golterman told the Board of Aldermen last week that, according to St. Charles Tower’s attorney, church leaders no longer believe the new cell tower would serve the best interests of the community.

“Therefore they have terminated their leasing arrangement with the tower company. So for now that case is gone,” he said.

Mayor Roy Robinson said he appreciated the church’s reconsideration.

“I’m glad the church got together and saved all of us a lot of time within the court system, and when you do that you save money,” he said.
